Terms of Use

Tonnix acts as an agent for persons who wish to share ownership of lottery tickets (e.g., Mega Millions, Power Ball, etc.) with other persons by pooling their money and sharing the ticket ownership and any winnings. Because Tonnix creates many pools, not all players will share all winnings.

As an agent for each person, Tonnix provides the following services: Tonnix selects the numbers to be purchased for each lottery ticket; locates other persons wishing to pool their money; assigns each person to the tickets that will be purchased; posts ticket numbers and pool information (members, drawing dates, etc.) online; purchases lottery tickets on behalf of each person; stamps the back of each ticket designating Tonnix as agent for the persons sharing the tickets; checks each ticket for winnings; maintains ownership records for each person; posts the winnings online after each drawing; and oversees the collection and distribution of all winnings. The cost of these services, as well as the cost of the tickets, is included in the price of each Tonnix membership. All tickets will be purchased with the lump sum cash payment option unless that option is not available.

A Tonnix pool has 10 shares. A person can buy only one share in each pool; however, a person can open multiple accounts, thus joining several pools.

Acceptance of Terms of Use
These Terms of Use govern your use of the Tonnix service and website. By using, visiting, or browsing the Tonnix site, you accept and agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you should not use the Tonnix services or website.

These Terms of Use are an ongoing contract between you and Tonnix, and apply to your use of the Tonnix service and website. These Terms of Use affect your rights, and you should read them carefully.

Changes to Terms of Use
Tonnix, LLC, reserves the right, from time to time, with or without notice to you, to change these Terms of Use at our sole and absolute discretion. The most current version of these Terms of Use can be reviewed by clicking on "Terms of Use" located at the bottom of the pages of the Tonnix website. The most current version of the Terms of Use will supersede all previous versions. Your use of the Tonnix website or continued use of our service after changes are made means that you agree to be bound by such changes.

Billing
By using the Tonnix service, you expressly agree that we are permitted to bill your account(s) at the end of each pool.

Automatic Renewals
Your Tonnix accounts will be automatically renewed on a four-week basis. You must cancel your accounts before the time of renewal in order to avoid having your Payment Method billed for the next four weeks subscription fees.

Cancellation
You may cancel your subscription to Tonnix at any time, and cancellation will be effective immediately. To cancel, click "Cancel Membership" on the "Account Options" page, and follow the instructions for cancellation under the heading "Cancel Membership." WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-POOLS SUBSCRIPTION PERIODS. Upon cancellation, at the end of the current pools, we will send you a check for all of your winnings. We reserve the right to terminate your account for any or no reason.

Account Access; Identity Protection
In order to provide you with ease of access to your account, Tonnix will place a cookie (a small text file) on any computer from which you access the Tonnix website. When you revisit the Tonnix site, this cookie will enable us to recognize you as the account holder. You are responsible for updating and maintaining the truth and accuracy of the information you provide to us relating to your account.

You are also responsible for maintaining the confidentiality of your account and password, and for restricting access to your computer. You may choose to share your account with other people by providing them your password. However, if you decide to share your account with other people, you take full responsibility for their actions. Users of public or shared computers should log out at the completion of each visit to the Tonnix website.

If you find that you're a victim of identity theft and it involves a Tonnix account, you should notify Tonnix Customer Service. Then, you should report the incident to all your credit card issuers, as well as your local law enforcement agency. Tonnix reserves the right to place any account on hold anytime, with or without notification to the subscriber, in order to protect itself and its partners from what it believes to be fraudulent activity. Tonnix is not obligated to credit or discount a membership for holds placed on the account by either a representative of Tonnix or by the automated processes of Tonnix.

Disclaimers of Warranties and Limitations on Liability
The Tonnix service and website and its contents are provided "as is," and we make no representations or warranties of any kind with respect to the Tonnix website, its contents, or our service. We assume no liability or responsibility for any errors or omissions in the content of the Tonnix website, any losses or damages arising from the use of the content provided on the Tonnix website, or any conduct by users of the Tonnix service or website. We disclaim all representations and warranties, including, for example, warranties of merchantability, fitness for a particular purpose, and non-infringement. In addition, we do not represent or warrant that the information accessible via our site is accurate, complete, or current.

In no event shall Tonnix, its shareholders, directors, officers, or employees be liable (jointly or severally) to you for any special, incidental, indirect, or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use or performance of the Tonnix website, its contents, or our service. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.

All content included on the Tonnix website and delivered to subscribers as part of the service, text, graphics, logos, designs, photographs, button icons, images, data compilations, and software, is the property of Tonnix, LLC, or its suppliers and is protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of Tonnix, LLC, and is protected by U.S. and international copyright laws. Content should not be reproduced or used without express written permission from Tonnix, LLC, or its suppliers. Tonnix reserves the right to terminate your membership hereunder if Tonnix, in its sole and absolute discretion, believes that you are in violation of this paragraph.

Your Conduct on the Tonnix Website
By accessing the Tonnix website, you agree not to upload, post, e-mail, or otherwise send or transmit any material that contains software viruses or any other computer codes, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Tonnix website. You also agree not to interfere with the servers or networks connected to the Tonnix website or to violate any of the procedures, policies, or regulations of networks connected to the Tonnix website, the terms of which are incorporated herein. You also agree not to impersonate any other person while using the Tonnix website, conduct yourself in a vulgar or offensive manner while using our service, or use the Tonnix website for any unlawful purpose.

Limitations on Use
You must be 18 years of age or older to subscribe to the Tonnix service. Subscribers may not be nor have ever been an employee of any United States state lottery.

Right to Terminate
We reserve the right to terminate or restrict your use of our service, without notice, for any or no reason whatsoever.

Ownership
The parties shall jointly own an interest in any ticket and all the proceeds of any prize claimed by the parties as tenants in common. The Players shall have eighty percent (80%) ownership interest, and Tonnix shall have twenty percent (20%) ownership interest in any such ticket and proceeds. Tonnix will acquire and hold for the parties any ticket purchased.

Taxes
Each party specifically agrees and acknowledges that it is responsible for the payment of its own taxes on income received from the joint ownership of lottery tickets as well as filing any required forms with the United States Internal Revenue Service or the appropriate local authorities.

U.S. residents are responsible for taxes on winnings, including federal, state, and local taxes.

Disclaimer
Tonnix shall have no duty to purchase tickets for joint ownership or claim the prize for any winning ticket if prevented from doing so by acts of God, the actions of any state lottery commission or federal state and local governments, or for any reason beyond the control of Tonnix and its agents or employees.

Members understand the high degree of risk involved in playing lotteries and acknowledge that participating in a Tonnix pool does not guarantee members that they will win any prize.

Tonnix agrees to purchase lotto tickets, manage Tonnix pools, and distribute any winnings to the appropriate pool.
